Commercial Data
Through the use of the Shopping Tunnel Service of the online store, the information entered allows us to manage the purchasing process with the description of your order and the connection of personal information. These data are essential to finalize the procedure with a delivery at home or at a collection point.
When using the Service, you have the option of creating a “Customer” account to manage and preserve your entered information or to remain a “Guest” for the duration of the business relationship and outside of the 10-year accounting requirement.
The essential information required to use the Service is:
- The selection of your order;
- An email address;
- Your first and last name;
- A phone number;
- A billing address;
- A shipping address;
- Information to facilitate delivery;
Recipients of certain commercial data
Some data are exported for accounting purposes. Other information is processed by Service Provider Companies to finalize the delivery of your orders or to manage the distribution to a collection point.
Legal basis for processing
- Order management: the legal basis for the processing is the execution of a contract (Cf. article 6.1.b) of the European Data Protection Regulation).
- Sending commercial solicitations by e-mail on products similar to those ordered by customers: the legal basis for the processing is the legitimate interest of the company (see Article 6.1.f) of the European Data Protection Regulation), namely to promote our products to our customers.
- Sending commercial solicitations by email about other products offered by Emma Distinction: the legal basis for the processing is consent (see article 6.1.a) of the European Data Protection Regulation), as required by article L. 34-5 of the French Post and Electronic Communications Code.
- Transmission of the e-mail address to commercial partners: the legal basis for the processing is consent (see Article 6.1.a) of the European Data Protection Regulation), as required by Article L. 34-5 of the French Post and Electronic Communications Code.
Personal Data
When you use our Service, we may ask you to provide certain personally identifiable information that can be used to contact or identify you (“Personal Information”). Personally identifiable information may include, but is not limited to:

Emma Distinction may process your Personal Data:

Data retention
Emma Distinction will retain your Personal Information only for as long as is necessary for the purposes stated in this Privacy Policy. We will retain and use your Personal Information to the extent necessary for us to fulfill our legal obligations (e.g., to comply with applicable law), resolve disputes and enforce our agreements and policies.
Emma Distinction will also retain Usage Data for internal analysis. Usage Data is generally retained for a shorter period of time, except where such data is used to enhance security or improve the functionality of our Service, or where we are legally required to retain such data longer.
Duration of data retention
- Data necessary for the management of orders and invoicing: for the entire duration of the commercial relationship and ten (10) years for accounting purposes.
- Data necessary for the realization of loyalty actions and canvassing: for the entire duration of the commercial relationship and three (3) years from the last purchase.
- Data relating to means of payment: we do not have access to this data; the transactions are carried out directly by Crédit Mutuel on the platform of its provider Monetico.
- Data concerning opt-out lists: three (3) years.
Data transfer
Information about you, including your Personal Data, may be transferred from your region, province, country, or other territorial division to, and stored on, computers located in a place where data protection laws differ from those of the territory in which you reside.
If you reside outside of France and choose to provide information to us, please be aware that we transfer data, including Personal Information, to France and process it there.

To complete orders and purchases on Emma Distinction we use third party payment processing services (i.e. payment processors).
We will not collect or store your payment card information. This data is shared directly with third-party payment processors, which use your personal data in accordance with their privacy policies. These payment processors comply with the PCI-DSS standard managed by the PCI Security Standards Council, which is a collaborative effort between brands such as Visa, MasterCard, American Express and Discover.
